Alabama

Who is authorized to perform ceremony? Any licensed minister of the gospel in regular communion with the Christian church or society of which he is a member may perform marriages. Also, marriages may be performed by the pastor of any religious society according to the rules of the religious society. Ministers must provide a certificate of the marriage to the judge of probate within one month after the marriage. Most judges.

Alaska

Who is authorized toperform ceremony? by a minister, priest, or rabbi of any church or congregation in the state, or by a commissioned officer of the Salvation Army, or by the principal officer or elder of recognized churches or congregations that traditionally do not have regular ministers, priests, or rabbis, anywhere within the state; by a marriage commissioner or judicial officer of the state anywhere within the jurisdiction of the commissioner or officer; or before or in any religious organization or congregation according to the established ritual or form commonly practiced in the organization or congregation

The person performing the marriage must complete two short-form certificates, and, after that person and the two witnesses have signed them, give one to each of the parties to the marriage. The original marriage certificate shall be filed as required by AS 18.50 (Vital Statistics Act) and regulations adopted under it. It must be done within 7 days

Arizona

Who is authorized to perform ceremony? Licensed or ordained clergy and most judges. “Licensed or ordained clergymen” includes ministers, elders, or other persons authorized by “a religious society or sect” to solemnize marriages or officiate at marriage ceremonies.

Where can the ceremony be performed? Licenses issued by any county are good througout the state. A town or city clerk may issue marriage licenses if they are more than four miles from the county seat

Arkansas

Who is authorized to perform ceremony? Any regularly ordained minister or priest of any religious sect or denomination may perform marriages. Ministers must have their ordination credentials filed by the county clerk who will then issue a certificate to the minister.

Where can the ceremony be performed? The license can only be used within the State of Arkansas.

Who is authorized to perform ceremony? A priest, minister, or rabbi of any religious denomination; most judges; A U.S. magistrate or retired magistrate; A legislator or constitutional officer of this state or a of Congress who represents a district within this state, while that person holds office.

Colorado

Who is authorized to perform ceremony? Marriages may be performed by any minister. Couples themselves may solemnize their own marriage (C.R.S 14-2-109). They must apply for paper work from the County Courthouse in order to do this. However, friends or relatives can not solemnize their marriage. Out-of-state Clergy need not be registered in Colorado.

Where can the ceremony be performed? The license can only be used within the State of Colorado.

Who is authorized to perform ceremony? All ordained or licensed clergymen belonging to this state or any other state may perform marriages as long as they continue in the work of the ministry.

Delaware

Who is authorized to perform ceremony? Any ordained minister of the gospel and every minister in charge of a recognized church may perform marriages. Ministers do not need to be licensed to perform marriages but they must report their name and address to the local registrar in the district in which they live.

Where can the ceremony be performed? The license can only be used within the State of Delaware.

Florida

Who is authorized to perform ceremony? A regularly ordained minister or other ordained clergy; Elders in communion with some churches; All judicial officers (Judges) of the State of Florida; Clerks of Circuit Court and their deputies of the State of Florida; and Notaries Public of the State of Florida. In addition, the law provides that marriages may be performed among “Quakers” or “Friends”, in the manner and form used or practiced in their societies. “A regularly ordained minister” is one who has been recognized in the manner required by the regulations of the respective denomination to perform marriage ceremonies.

Illinois

Who is authorized to perform ceremony? A marriage may be solemnized by most judges, by a county clerk in counties having 2,000,000 or more inhabitants, by a public official whose powers include solemnization of marriages, or in accordance with the prescriptions of any religious denomination, Indian Nation or Tribe or Native Group, provided that when such prescriptions require an officiant, the officiant be in good standing with his religious denomination, Indian Nation or Tribe or Native Group.

Where can the ceremony be performed? A license to marry becomes effective in the county where it was issued one day after the date of issuance, unless the court orders that the license is effective when issued, and expires 60 days after it becomes effective.

A member of the clergy of a religious organization (even if the cleric does not perform religious functions for an individual congregation), a judge, a mayor (within the mayor’s county), a clerk or a clerk-treasurer of a city or town (within a county in which the city or town is located), a clerk of the circuit court, The Friends Church, in accordance with the rules of the Friends Church, The German Baptists, The Bahai faith, The Church of Jesus Christ of Latter Day Saints, an imam of a masjid (mosque).

Ministers of the gospel or priests of any denomination in regular communion with any religious society; Justices and judges of the Court of Justice, retired justices and judges of the Court of Justice except those removed for cause or convicted of a felony, county judges/executive, and such justices of the peace and fiscal court commissioners as the Governor or the county judge/executive authorizes; A religious society that has no officiating minister or priest and whose usage is to solemnize marriage at the usual place of worship and by consent given in the presence of the society, if either party belongs to the society.

Who is authorized to perform ceremony? A marriage may be solemnized in any place within the commonwealth by the following persons who are residents of the commonwealth: a duly ordained minister of the gospel, by a justice of the peace, or a registrar, or a leader of an Ethical Culture Society which is duly established in the commonwealth and recognized by the American Ethical Union. Churches and other religious organizations shall file in the office of the state secretary information relating to persons recognized or licensed as aforesaid, and relating to usages of such organizations, in such form and at such times as the secretary may require.

Who is authorized to perform ceremony? Marriages may be solemnized by any clergyman, either active or retired, who is in good standing with any church or synagogue in this state. Marriages may also be solemnized, without compensation, by any judge, including a municipal judge. Marriages may also be solemnized by a religious society, religious institution, or religious organization of this state, according to the regulations and customs of the society, institution or organization, when either party to the marriage to be solemnized is a member of such society, institution or organization.

Who is authorized to perform ceremony? Persons who may now solemnize a marriage include a judge of a court of record, a public official whose powers include solemnization of marriages, by a mayor, city judge or justice of the peace, by a tribal judge, or in accordance with any mode of solemnization recognized by any religious denomination, Indian nation or tribe, or native group (40-1-301).

Who/How is license returned? After the marriage ceremony, the person who performed the ceremony must return the license to the Clerk’s office within 30 days for completion. Once it is returned to the couple, the license can be used as proof of name change with Social Security and in changing the name on a driver’s license.

Who is authorized to perform ceremony? Any ordained clergyman whatsoever, without regard to the sect to which they belong may perform marriages.

West Virginia
